英國物業法近40年最大改革 7項新措施一文睇清

英國政府今年1月初宣佈即將改革物業法,提案包括7項新措施:

  • 租賃業權(Leasehold)可以零地租續租990年,涵蓋洋房(House)及分層單位(Flat)

  • 設地租上限

  • 設關於地租的網上計算機

  • 成立共同業權委員會(Commonhold Council)

  • 廢除「婚姻價值(Marriage Value)」等高昂費用

  • 租賃持有人可限制物業發展以避免支付「發展價值(Development Value)」

  • 退休租賃物業(Retirement Leasehold Properties)的地租減至零


頭3項措施之前已經講過,今次闡釋其餘4項。共同業權委員會(Commonhold Council)是由租賃業權團體、業界及政府組成的伙伴關係,專門負責管理共同業權事宜。共同業權允許業主以永久業權方式擁有其物業,並與其他共同業權持有人共同擁有和管理街區。法律委員會財產法專員尼克·霍普金斯教授指:「設立共同業權委員會應有助重振共同業權,確保業主能宣稱自己的房屋屬於自己。(The creation of the Commonhold Council should help to reinvigorate commonhold, ensuring homeowners will be able to call their homes their own.)」


此外,英國物業有所謂「婚姻價值(Marriage Value)」,是指延長租約完成後物業價值的增加,反映較長租約的附加市場價值。新例下,「婚姻價值」之類的高昂續租費用將被取消,政府將設定計算率以確保續租公平、便宜且透明。租賃業權持有人將來更可以自願同意限制其物業的未來發展,以避免支付「發展價值(Development Value)」。


長者亦將受進一步保護。英政府先前已承諾將新租賃的地租限制為零,新例之下,上述措施將適用於退休租賃物業(Retirement Leasehold Properties,一種專門為老年人建造的房屋),未來,這些房屋的業主將與其他房屋業主享有相同權利,且可以免受不確定及掠奪行為影響。

不過上述新法仍未落實,改革提案將盡快在議會提出並審議,故目前仍沿用舊例。
